TERMS & CONDITIONS
Video Monkey (“we”, “our”, “us”) reserves the right to change or modify this Agreement, and any policy or guideline incorporated by reference, at any time at its sole discretion.
The Customer (“you”, “your”) accepts our Terms of Service, detailed herein, by using our site and services. You agree that you have reviewed and understand the content within.
Any changes or modifications will be effective upon posting of the revisions on this document at Video Monkey Terms.
You are responsible for regularly reviewing the Site to obtain timely notice of such changes or modifications. Your continued use of the Services following any changes or modifications constitutes your acceptance of such changes or modifications. IF YOU DO NOT AGREE TO THE TERMS OF ANY MODIFICATION, DO NOT CONTINUE TO USE THE SERVICES AND IMMEDIATELY NOTIFY US OF YOUR DECISION TO CANCEL THIS AGREEMENT.
This agreement supersedes all previous agreements between Video Monkey and the Customer, regardless of when they were made.
TESTIMONIAL DISCLAIMER
Our Site may contain testimonials from actual users of our products and/or services. These testimonials reflect the true and own opinions and experiences of the users. We do not pay or manipulate these testimonials. They appear on our Site as provided by the users, except for the correction of grammar or typographical errors.
However, you understand that these experiences are personal to those particular users, and may not necessarily represent everyone’s experience with our products and/or services. Your individual results may vary.
NON-SOLICITATION
You agree not to induce or attempt to induce any video editor, manager, employee, contractor, or customer of ours to leave their engagement with us. You shall not solicit, entice, or hire away any such individuals, or otherwise negotiate or communicate with them outside the usual scope of our services.
Violations of this agreement may result in legal action, including an injunction to restrain further violations and recovery of damages, including punitive damages.
MONEY BACK GUARANTEE
We do not offer a money back guarantee for our services or products, except under special exceptions determined at our sole discretion. Refund requests can be made by emailing hello@videomonkey.net with the subject line “Refund Request”.
PAYMENTS & REFUNDS
Payments are nonrefundable, except as provided in the Money Back Guarantee. You authorize Video Monkey to charge your payment method for the service fee upon registering. Non-payment may result in suspension of service. You agree to provide accurate payment information and to update it as necessary.
EXPIRATION
Unused purchases (edit credits, packages, etc.) expire 90 days from the date of purchase. It is your responsibility to track these dates. Extensions can be requested via your Video Order Management Application (VOMA) dashboard.
ACCURACY & QUALITY
While we strive for perfection, we cannot guarantee that all files will be error-free. You are responsible for reviewing and proofing all files upon delivery. We are not liable for losses or expenses incurred from errors or omissions.
OWNERSHIP & LIMITED RIGHTS
You retain ownership of any content and files sent to us. You grant us the rights necessary to complete our tasks, including retaining archival copies and using the content for internal training.
By default, you grant us a non-exclusive right to publish your work in our portfolio and promotional materials. This right can be revoked by notifying us in writing.
INTELLECTUAL PROPERTY
Our business operations, methodologies, systems, applications, and software are our exclusive intellectual property. You agree not to replicate or reproduce them.
OUTPUT & TURNAROUND TIMES
Our output volume depends on the complexity and number of requests. We suggest not using our service for time-sensitive requests. Standard turnaround times are 48 hours for horizontal video editing and 24 hours for vertical video editing, subject to the volume and complexity of the footage.
REVISIONS & COMPLETIONS
We offer an unlimited number of reasonable revisions per video order. Orders are considered completed if no revisions are requested within 5 days of delivery. Completed orders cannot be reopened unless determined otherwise at our discretion.
COPYRIGHT
We use copyright-free or licensed assets. We are not responsible for copyright infringements if you request the use of copyrighted materials.
LIMITATION OF LIABILITY
We are not liable for any loss or damages arising from our services. You agree to indemnify Video Monkey against all claims related to our services. We are not liable for any monetary damages or other kind of damages and claims under this agreement.
SEVERABILITY
If any part of this Agreement is deemed invalid or unenforceable, the remainder shall remain in effect.
GOVERNING LAW
This Agreement shall be governed by the laws of India, without regard to its conflict of law provisions.
GENERAL PROVISIONS
The contents of this Agreement apply to all affiliates and associates involved in
your use of our services. You are responsible for their adherence to this Agreement.
